Terms and conditions of sale

Article I. General provisions

These General Terms and Conditions of Sale apply without restriction or reservation and define the rights and obligations of the parties in connection with the reservation of apartments ("The Services") offered by MY MAISON IN PARIS ("The Provider") to consumers ("The Customer").

The customer is obliged to read them before booking. The choice and purchase of a Service is the sole responsibility of the Customer.

The Customer declares that he/she has read and accepted these General Terms and Conditions of Sale before entering into the contract for the provision of Services. Validation of the order for Services by the Customer implies unreserved acceptance of these General Terms and Conditions of Sale.

These conditions apply to the exclusion of all other conditions, in particular those applicable to other sales channels for the Services.

These general terms and conditions also include the Customer Privacy Policy. By accepting these terms and conditions, the customer expressly accepts the provisions of this Charter.

Article II. Booking Conditions

Reservations can be made by the customer on the Provider's website(www.mymaisoninparis.com) or directly by telephone or e-mail.

The process leading to the reservation of one or more apartments includes the following steps (not exhaustive):

  • Enter dates of stay.
  • Choice of accommodation.
  • Enter the number of people staying in the selected accommodation.
  • Tariff selection.
  • Validation of stay.
  • Enter personal and payment data.
  • Payment confirmation.
  • Notification to the customer of the successful booking (via a dedicated screen on the site, followed by a summary email).

For all bookings, the name of the holder of the means of payment must be identical to that used at the time of booking. To this end, the supplier reserves the right to ask the customer for a photo of him/herself with the means of payment in hand. In the event of doubt or inconsistency, the supplier cannot be held liable and may unilaterally cancel the reservation without penalty.

The full amount of the stay will be debited on the day of booking. This amount may or may not be refunded, depending on the following criteria:

  • if the fare selected is "Non-Cancellable Non-Refundable" (NANR), this amount will not be refunded in the event of a no-show or cancellation.
  • if the rate selected is "Flexible", in the event of cancellation :

- 100% of the amount will be refunded within 14 days if the reservation is cancelled within the 15 days prior to the reservation.

- 50% of the amount will be refunded within 14 days if the reservation is cancelled between the 15th day and the3rd day before the reservation date.

- 100% of the reservation amount will be retained by the service provider if the cancellation is made within 2 days of the arrival date at one of our residences.

It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately.

The sale of Services shall not be deemed final until the Service Provider has sent the Customer confirmation of acceptance of the order and has collected the full price and the full deposit due.

Prices for booking services are indicated at the time of booking.

The prices indicated are per apartment for the number of person(s) and date(s) selected.

Prices are confirmed to the customer in the commercial currency of our residences, i.e. the Euro, and are only valid for the period indicated on the site.

All bookings, whatever their origin, are payable in the local currency of our residences, unless special arrangements are indicated on site.

Foreign currency conversions are given for information only and are not contractually binding.

Unless otherwise stated, additional services (extra cleaning, etc.) are not included in the price.

Prices include VAT applicable on the date of the order, and any change in the VAT rate will automatically be reflected in the prices indicated on the date of invoicing. The same applies to tourist tax.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the date of invoicing.

Rates may be increased by various taxes depending on the city/country. The customer undertakes to pay the various taxes without any dispute.

Article III. Cancellation conditions

In accordance with article L. 221-28, paragraph 12, of the French Consumer Code, customers are reminded that, for accommodation services, they do not have the right of withdrawal provided for in article L. 222-18 of the French Consumer Code, which is excluded for contracts for accommodation services to be provided on a specific date or during a specific period.

The special booking conditions specify the terms and conditions for cancelling and/or modifying the booking. More specifically, for each stay the customer can choose between two rates:

  • Non-cancellable Non-refundable: This fare does not entitle the customer to a refund in the event of cancellation.
  • Flexible: in the event of cancellation :

- 100% of the amount will be refunded if the reservation is cancelled within the 15 days prior to the reservation.

- 50% of the amount will be refunded if the reservation is cancelled between the 15th day and the3rd day before the reservation date.

- 100% of the booking fee will be retained by MY MAISON IN PARIS if the cancellation is made within 2 days of the booking start date. MY MAISON IN PARIS will not refund the full amount of the stay. The customer may then claim these rights through their personal insurance, if they so wish.

When the particular conditions of the reservation allow it: cancellation or modification of the reservation can be made directly with the residence, by email or telephone.

In the event of cancellation by MY MAISON IN PARIS, a 100% refund will be made.

In the event of interruption of the stay (i.e. unexpected departure of the customer) no refund will be made.

Unless expressly agreed otherwise, apartments are available from 3.00 pm on the day of arrival and the customer must vacate the room by 11.00 am on the last day of the reservation. Failure to do so will result in an additional night's charge.

Article IV. Terms of payment

Payment for all services is made directly on the service provider's website.

The price is payable in cash, in full, on the day the reservation is made by the Customer, according to the terms specified in the "Reservation" article above, by secure payment:

  • by credit card: Visa, MasterCard, American Express, other credit cards

In addition, the Service Provider reserves the right, in the event of non-compliance with the above payment conditions, to suspend or cancel the provision of the Services ordered by the Customer and/or to suspend the performance of its obligations.

  1. The customer communicates his bank details directly by entering the card number, without any spaces between the digits, as well as the validity date and the visual cryptogram in the field provided for this purpose. The communication of credit card identification numbers and validity dates is secured by an SSL (according to current standards) and PCI (according to current standards) encryption and protection system for banking data. The customer's payment card is also checked for validity by the various parties involved and partners, and may be refused for various reasons: stolen or blocked card, limit reached, input error, etc...
  2. In this case, it is the customer's responsibility to contact the bank issuing the means of payment in question directly, or the establishment for transmission of another means of payment, in order to confirm the effectiveness of the reservation.

For all credit card payments, the customer must send MY MAISON IN PARIS a photo of the credit card, which must have the same name as the reservation.

The means of online payment available are expressly mentioned on the site, the enumerative list being likely to evolve.

The credit card used for payment may be requested by the establishment upon arrival.

In order to prevent credit card fraud, the establishment may ask the customer to show proof of identity when handing over the credit card used for payment.

Article V. Stay - commitments and responsibility of the customer

The customer is solely responsible for the choice of services and the choice of establishment booked via the mymaisoninparis.com website and for their suitability for the customer's needs.

The customer is also solely responsible for the information communicated in the context of reservations made, so that he/she must bear full responsibility for any communication of erroneous or fraudulent information.

The customer undertakes to comply with French legislation and regulations, as well as with the clauses stipulated in these General Terms and Conditions of Sale. Should the customer fail to do so, he/she will be held liable for any damage caused by him/her to MY MAISON IN PARIS and/or any third party.

By making a definitive reservation, the customer undertakes to pay the full price (including taxes).

Any booking or payment that is irregular, inoperative, incomplete or fraudulent for any reason attributable to the customer will result in the cancellation of the booking at the customer's expense, without prejudice to any compensation claim against the customer.

In application of French legislation and regulations, on arrival at the residence, customers will be asked to show proof of identity in order to verify their origin. If they are of foreign origin, they must complete a police form. In accordance with regulations, data is kept for 6 months.

The customer accepts and undertakes to use the apartment with due care. Any behavior contrary to good morals and public order will lead the operator to ask the customer to leave the establishment immediately without any compensation and/or without any refund if payment has already been made.

Smoking is strictly prohibited in apartments and on the premises of MY MAISON IN PARIS : common areas, building entrances, stairways, elevators.

Unfortunately, pets are not allowed on MY MAISON IN PARIS.

The customer also undertakes to ensure that the computer resources made available by the establishment (in particular the hardware and WiFi network) are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by neighboring rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. The customer undertakes not to consult any illicit content. The customer is also required to comply with the security policy of the establishment's Internet service provider, including the rules governing the use of security measures implemented to prevent the illicit use of IT resources, and to refrain from any action that might undermine the effectiveness of these measures.

The MY MAISON IN PARIS establishments accept no responsibility for theft, loss or damage to guests' belongings during their stay.

The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises, committed by the customer himself or by the occupants or staff for whom he is responsible, both to the goods, works and equipment in the rooms and communal areas and to the Internet network made available to him, such as loss of data, viruses, disruption of service. He/she will also be liable for any bodily injury, personal injury, assault or sexual abuse committed against a hotel employee or another guest.

Article VI. Force majeure

The Parties shall not be held liable if the non-performance or delay in performance of any of their obligations as described herein is due to force majeure, as defined in article 1218 of the French Civil Code.

Article VII. Claims

All claims must be sent in the first instance by registered post (return receipt requested) to MY MAISON IN PARIS - 4 rue Quentin Bauchart- 75008 Paris, no later than 15 days after the date of occurrence of the event giving rise to the damage. After this deadline, no claim will be considered.

Any legal action must be preceded by an attempt to settle the dispute amicably, so that the customer undertakes to contact the customer service department managed by MY MAISON IN PARIS, either at the above address, or by e-mail(contact@mymaisoninparis.com).

In the event of a negative response, or in the absence of a response, the establishment concerned and the Customer will have the option of implementing an alternative dispute resolution method, such as conventional mediation or court conciliation (Art. 1530 et seq. of the French Code of Civil Procedure / Art. L.611-1 et seq. of the French Consumer Code.

Article VIII. Protection of personal data

Personal data is collected and processed in the strictest confidence and in accordance with the provisions of Act no. 78-17 of January 6, 1978, as amended, on Data Processing, Data Files and Individual Liberties and European Regulation no. 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data ("RGPD"), by the company MY MAISON IN PARIS, in its capacity as data controller and whose contact details are as follows:

The legal basis for the processing of personal data is the performance of the reservation contract between you and MY MAISON IN PARIS and is used primarily to manage your reservations. We may also use your personal data to carry out surveys, market research, statistical analysis and global trend analysis in order to improve our products and services. If you have given your consent, your personal data may be used to send you the MY MAISON IN PARIS newsletter or to send you commercial messages about products or services that may be of interest to you.

Article IX. Applicable law - Jurisdiction

Any dispute relating directly or indirectly to the performance of these General Terms and Conditions of Sale, concerning the reservation of one or more apartments MY MAISON IN PARIS, or the performance of hotel services complementary to the accommodation services, will be subject to French legislation and regulations and must be brought before the competent French courts; Having duly read and understood all the provisions of these General Terms and Conditions of Sale, the customer hereby accepts that, in the event of a dispute with MY MAISON IN PARIS, the courts of Paris shall have jurisdiction, regardless of the customer's nationality.

These General Terms and Conditions of Sale are written in French.

Should they be translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

Article X. Pre-contractual information - Customer acceptance

The Customer acknowledges having been informed, prior to the immediate purchase or the placing of his order and the conclusion of the contract, in a clear and comprehensible manner, of the present General Terms and Conditions of Sale and of all the information listed in article L.221-5 of the French Consumer Code and in particular the following information:

  • the essential characteristics of the Service;
  • the price of Services and ancillary costs ;
  • cancellation conditions ;
  • information relating to the identity of the Service Provider, its postal, telephone and electronic contact details, and its activities, if not obvious from the context;
  • the functionalities of the digital content and, where applicable, its interoperability ;
  • the possibility of resorting to conventional mediation in the event of a dispute.
