MY MAISON IN PARIS
Article I. General provisions
These General Terms of Sale apply, without restriction or reservation, and define the rights and obligations of the parties in the booking of apartments (“The Services”) offered by MY MAISON IN PARIS (“The Provider”) to consumers (“The Customer”)..
The Customer is required to review réservationit beforebooking. Choosing and purchasing a service is the customer’s sole responsibility.
The Customer states that he became aware of these General Terms of Sales and accepted them prior to the conclusion of the contract to provide the Services. The validation of the Service order by the Customer is worth unrestricted or reserved acceptance of these General Terms of Sale.
These conditions apply to the exclusion of all other conditions, including those applicable for other services marketing channels.
These terms and conditions also include the Customer Privacy Charter. In agreeing to these terms and conditions, the client expressly accepts the provisions of this Charter.
Article II. Booking Conditions
Reservations can be made by the customer on the Provider’s website (www.mymaisoninparis.com) or directly by phone or email.
The process leading to the booking of one or more apartments includes the following (non-exhaustive) steps:
- Entering dates of stay.
- Choice of accommodation.
- Entering the number of people staying in the chosen accommodation.
- Price selection.
- Validation of the stay.
- Entering personal and payment data.
- Confirmation of payment.
- Notify the customer of the correct consideration of his booking (by a dedicated screen on the site, then by an email summary).
For any booking, the name of the holder of the means of payment must be identical to that used at the time of booking. To this end, the provider reserves the right to ask the Customer for a photo of himself with the means of payment in hand. In case of doubt and inconsistency, the claimant cannot be hired and can cancel the booking without any unilateral penalty.
Thefull amount of the stay will be charged on the day of booking. This amount will or will not be refunded based on the following criteria:
- If the selected rate is “Non-Cancellable Non-Refundable” (NANR), this amount will not be refunded in case of non-arrival or cancellation.
- If the selected rate is “Flexible” in the event of cancellation:
– 100% of the amount will be refunded within 14 days if the cancellation of the booking takes place in the period before the 15 days before the booking.
– 50% of the amount will be refunded within 14 days if the cancellation of the booking takes place between the15th day and the 3rdème day before the booking date.
– 100% of the booking amount will be retained by the provider if the cancellation takes place within 2 days of the arrival date at one of our residences.
It is up to the Customer to verify the accuracy of the order and immediately report any errors.
The sale of Services will only be considered final after the Customer has been sent confirmation of the acceptance of the order by the Provider and after the Provider receives the full price and after the customer receives the entire deposit due.
Prices for booking services are shown at the time of booking.
Prices are per apartment for the number of people and the date selected.
Prices are confirmed to the customer by amounting to TTC, in the commercial currency of our residences, namely the Euro, and are valid only for the duration indicated on the site.
All bookings, regardless of their origin, are payable in the local currency of our residences, unless there are special provisions indicated on site.
The conversion to foreign currency is given as an indication and not contractual.
Unless otherwise stated, supplementary benefits (additional household…) are not included in the price.
Prices take into account the VAT applicable on the day of the order and any change in the VAT rate will be automatically passed on to the prices shown on the billing date. The same is true of the residence tax.
Any changes or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be passed on to the prices indicated on the date of the billing.
Rates can be increased by different taxes depending on the city/country. The Customer agrees to pay the various taxes, without any dispute.
Article III. Cancellation conditions
The client is reminded, for accommodation services, in accordance with Article L. 221-28, paragraph 12, of the Consumer Code, that he does not have the right of withdrawal under Article L. 222-18 of the Consumer Code, which is excluded for contracts relating to accommodation services that must be provided on a specified date or period.
The specific terms of the booking specify the terms of cancellation and/or modification of the booking. Specifically, for each stay the customer has the choice between two rates:
- Non-Cancellable Non-Refundable: This rate does not allow the customer to be refunded in the event of cancellation.
- Flexible: in case of cancellation:
– 100% of the amount will be refunded if the cancellation of the booking takes place in the period before the 15 days before the booking.
– 50% of the amount will be refunded if the cancellation of the booking takes place between the15th day and the 3rdème day before the booking date.
– 100% of the booking amount will be retained by MY MAISON IN PARIS if the cancellation takes place within 2 days of the start date of the booking. MY MAISON IN PARIS will therefore not refund the amount of the entire stay. The client will then be able to assert these rights with his individual insurance, if he wishes.
When the specific conditions of the booking allow: the cancellation or modification of the booking can be done directly with the residence, by email or phone.
In the event of cancellation by MY MAISON IN PARIS, a 100% refund will be made.
In the event of an interruption of the stay (i.e. in case of unexpected departure of the customer) no refund will be made.
Unless expressly stated otherwise, the apartments are made available from 15.00 hours on the day of arrival and the guest must leave the room before 11.00am on the last day of booking. Failing that, he will be charged an additional night.
Article IV. Payment terms
The payment of all services is made directly on the provider’s website.
The price is payable in full on the day of the customer’s booking, according to the terms specified in the “Reservation” article above, by means of secure payment:
- by bank cards: Visa, MasterCard, American Express, other blue cards
In addition, the Provider reserves the right, in the event of non-compliance with the above payment terms, to suspend or cancel the provision of Services ordered by the Customer and/or to suspend the performance of its obligations.
- The customer communicates his bank details by indicating directly, in the area provided for this purpose, the card number, without spaces between the numbers, as well as its validity date and the visual cryptogram. The communication of the identification numbers and the validity date of the bank card is secured by an encryption and protection of banking data such as SSL (according to current standards) and PCI. The customer’s payment card is also subject to a validity check by the various stakeholders and partners and may be refused for various reasons: stolen or blocked card, ceiling reached, entry error, etc.
- In this case, it will be up to the customer to make direct contact with the Bank issuing the payment method in question, or with the establishment for transmission of another means of payment and this to confirm the effectiveness of its booking.
For each credit card payment, the customer must send my MAISON IN PARIS the photo of the credit card which must have the same name as that of the booking.
The online payment methods available are specifically mentioned on the site, as the list is likely to change.
The credit card used for payment may be requested by the establishment upon the customer’s arrival.
The establishment will be able to request the presentation of an ID for the purpose of preventing credit card fraud when the customer gives the credit card that resulted in the payment.
Article V. Stay – commitments and customer responsibility
The customer is solely responsible for the choice of services and the choice of the establishment he has booked via the mymaisoninparis.com website and their suitability to his needs.
The customer is also solely responsible for the information provided in connection with the bookings made, so that he will have to bear full responsibility for any disclosure of false or fraudulent information.
The customer is committed to complying with French law and regulations, as well as the clauses stipulated in these General Terms of Sale. In the event of the client’s failure, the customer will be held responsible for any damage caused by him to my MAISON IN PARIS establishments and/or to any third party.
The customer agrees by making a final reservation to pay the full price (including taxes).
Any booking or payment that is improper, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the booking at the customer’s expense, without prejudice to any compensation action against him.
In according with French law and regulations, the client will be asked on arrival at the residence to present an ID in order to verify his origin. If the latter is of foreign origin, then it will have to complete a police card.
The client agrees and agrees to use the apartment as a good family man. Therefore, any behaviour contrary to morals and public order will lead the operator to ask the customer to leave the establishment immediately without any compensation and/or refund if a settlement has already been made.
Smoking is strictly forbidden in apartments and within the grounds of MY MAISON IN PARIS: common areas, entrance to buildings, stairs, elevators.
Unfortunately, our animal friends are not allowed in MY MAISON IN PARIS establishments.
The client also undertakes that the computer resources made available by the institution (including computer equipment and the Wi-Fi network) are not used in any way for the purpose of reproducing, representing, making available or communicating to the public works or objects protected by copyright or neighbouring law, such as texts , images, photographs, musical works, audiovisual works, software and video games, without the permission of the owners of the rights to books I and II of the intellectual property code where this authorization is required. The customer undertakes not to view any illegal content. The customer is also required to comply with the security policy of the establishment’s internet service provider, including the rules for the use of security measures to prevent the illicit use of computer resources and to refrain from any acts that undermine the effectiveness of these means.
MY MAISON IN PARIS establishments do not accept any responsibility for theft, loss and degradation of customer-owned effects during their stay.
The client will be held responsible for any damage, damage, act of vandalism that may occur as a result of the occupation of the premises, committed on his own or the head of the occupants or the staff in his care, both on the property, structures and equipment furnishing the rooms and the common parts and on the internet network made available to him. , such as data loss, viruses, service disruption. He will also be liable for any bodily harm, injury, assault or sexual abuse committed against a hotel employee or other guest.
Article VI. Force majeure
Parties cannot be held liable if the non-performance or delay in the performance of any of their obligations, as described herethly, is the result of a case of force majeure, within the meaning of Article 1218 of the Civil Code.
Article VII. Claims
Any complaint must be addressed in the first place by registered mail A/R to MY MAISON IN PARIS – 4 rue Quentin Bauchart 75008 Paris, no later than 15 days after the date of occurrence of the cause of the damage. After this time, no claims will be taken into account.
Any legal action must be preceded by an attempt to settle the dispute amicably, so that customer agrees to refer the customer service managed by MY MAISON IN PARIS, either to the aforementioned address or by email ([email protected])
In the event of a negative response, or in the absence of a response, the institution concerned and the Client will have the power to implement an alternative method of dispute resolution, such as conventional mediation or conciliation in court (Art. 1530 and following of the Code of Civil Procedure / Art. L.611-1 and following consumer code
Article VIII. Personal data protection
Personal data is collected and processed in the strictest confidentiality and in accordance with the provisions of Amended Computer Science Act No.78-17 of January 6, 1978, files and freedoms and the European Regulations No. 2016/679 of 27 April 2016, relating to the protection of individuals with respect to the processing of personal data (“RGPD”), by my MAISON IN PARIS, in its capacity as a processing manager and whose contact information is as follows:

The legal basis of the processing of personal data is the execution of the booking contract that binds you to MY MAISON IN PARIS and is used mainly for the management of your bookings. We can also use your personal data to conduct surveys, market research, statistical analysis and global trends to improve our products and services. If you have given your permission, your personal data may be used to send you the MY MAISON IN PARIS Newsletter or send you commercial messages about products or services that may be of interest to you.
Article IX. Law applicable – competent court
Any dispute that has a direct or indirect connection to the execution of these General Terms of Sale, relating to the booking of one or more my MAISON IN PARIS apartments, or on the performance of hotel services complementary to accommodation services, will be subject to French legislation and regulations and must be brought before the competent French courts; Already, since the client has duly read all the provisions of these General Terms of Sale, he accepts that the territorial jurisdiction, in the event of a dispute between him and MY MAISON IN PARIS SAS , should be returned to the Paris Courts, regardless of his nationality.
These General Terms of Sale are written in French.
In the event that they are translated into one or more foreign languages, only the French text would be authentic in the event of a dispute.
Article X. Pre-contract information – Customer acceptance
The Customer acknowledges that he has been made, prior to the immediate purchase or placing of his order and the conclusion of the contract, in a clear and understandable manner, of these General Terms of Sale and all the information listed in Article L.221-5 of the Consumer Code and in particular the following information:
- The essential features of the Service
- The price of services and ancillary fees;
- Cancellation conditions
- information about the Provider’s identity, postal, telephone and electronic contact information, and its activities, if it is not in context;
- The functionality of digital content and, if so, its interoperability;
- the possibility of conventional mediation in the event of a dispute.
